1. Acceptance of Terms

Welcome to getREADYBAR.com (the "Site"), operated by ReadyBAR LLC, a California limited liability company doing business as READYBAR ("READYBAR," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of the Site and any purchase of products through it. By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use this Site and make purchases. By using the Site, you represent that you meet this requirement. If you are under this age, you may use the Site only with the involvement and consent of a parent or legal guardian.

3. Account Registration

To place certain orders or access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information;
• Maintain the confidentiality of your login credentials;
• Notify us immediately of any unauthorized use of your account; and
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

4. Products, Pricing & Availability

• All product descriptions, images, and prices are subject to change without notice.
• We make reasonable efforts to describe our products, ingredients, and nutrition information accurately, but we do not warrant that descriptions or images are error-free. The label on the product you receive is the most current source for ingredients, allergens, and nutrition facts.
• Prices are listed in USD and exclude taxes and shipping unless stated otherwise.
• We reserve the right to limit quantities, refuse orders, or discontinue any product at any time.
• In the event of a pricing or listing error, we reserve the right to cancel affected orders and issue a full refund.

5. Orders & Payment

• Placing an order constitutes an offer to purchase; a contract is formed only when we confirm and ship your order (or send a confirmation email of acceptance).
• We accept the payment methods shown at checkout.
• You represent that any payment information you provide is accurate and that you are authorized to use the payment method.
• Orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for reasons including suspected fraud, pricing errors, or unavailability of stock.
• You may cancel or change an order at no charge any time before it ships by emailing info@getreadybar.com with your order number.
• See our Shipping Policy and our Return & Refund Policy for delivery, cancellation, and refund terms, which are incorporated into these Terms by reference.

6. Pre-Orders

Some products may be offered for pre-order or on backorder. When you place a pre-order:

• Your payment method is charged when you place the order;
• The expected ship date is shown on the product page at the time you order; and
• You may cancel for a full refund at any time before the order ships.

If we cannot ship by the date shown, we will notify you and give you the choice described in our Shipping Policy.

7. Promo Codes & Discounts

• Promo codes cannot be combined with other codes or offers unless the offer says they can.
• Promo codes must be entered at checkout and cannot be applied to orders that have already been placed.
• Promo codes have no cash value and may not be sold or transferred.
• We may change or end any promotion at any time, and we may cancel orders that use a code in a way the offer does not allow.

8. Food Products, Allergens & Health Information

• Our products are food. Some of our products contain peanuts and other major food allergens. Always read the ingredient list and allergen statement on the product label before eating.
• Some products, including CHARGED! Espresso Mocha, contain caffeine. Caffeinated products are not recommended for children, people who are pregnant or nursing, or people who are sensitive to caffeine.
• Content on the Site is for general information only. It is not medical or nutrition advice and is not a substitute for advice from your doctor or a registered dietitian. If you have a medical condition or dietary restriction, talk to your doctor before making changes to your diet.

9. Personal Use; No Resale

Products sold on the Site are for personal use. You may not resell products purchased on the Site without our prior written authorization. We may limit or cancel orders that we believe are placed for resale. For wholesale, government, or agency purchasing, contact us at info@getreadybar.com.

10. Intellectual Property

All content on the Site - including text, graphics, logos, images, product photography, and software - is the property of READYBAR or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent.

11. User Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the Site, other accounts, or our systems;
• Interfere with or disrupt the Site's operation (e.g., via malware, bots, or scraping without permission);
• Submit false, fraudulent, or misleading information, including fraudulent payment details;
• Infringe on the intellectual property or privacy rights of others.

We reserve the right to suspend or terminate access for violations of this section.

12. User-Generated Content

If the Site allows you to submit reviews, comments, or other content ("User Content"), you grant READYBAR a worldwide, royalty-free, perpetual license to use, reproduce, and display that content in connection with the Site and our marketing. You represent that your User Content does not infringe any third-party rights and is not unlawful, defamatory, or obscene. We reserve the right to remove any User Content at our discretion.

13. Third-Party Links & Services

The Site may contain links to third-party websites or services (e.g., payment processors, social media). We do not control and are not responsible for the content, policies, or practices of any third-party site. Your use of third-party services is at your own risk and subject to their terms.

14. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such warranties cannot be excluded under applicable law (e.g., mandatory consumer-protection warranties in your jurisdiction). We do not warrant that the Site will be uninterrupted, secure, or error-free. Nothing in this section limits the Flavor Satisfaction Guarantee or the damaged, defective, or incorrect item coverage in our Return & Refund Policy.

15. Limitation of Liability

To the fullest extent permitted by applicable law, READYBAR and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or purchase of products. Our total aggregate liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid for the product(s) giving rise to the claim. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

16. Indemnification

You agree to indemnify and hold harmless READYBAR, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.

17. Termination

We may suspend or terminate your access to the Site or your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

18. Dispute Resolution

If you have a dispute with us, please contact us first at info@getreadybar.com and describe the issue. You and READYBAR agree to try in good faith to resolve the dispute informally for at least 30 days before either of us files a claim in court.

19. Governing Law

These Terms and any dispute arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict-of-laws principles. You and READYBAR agree to submit to the exclusive jurisdiction of the state and federal courts located in Alameda County, California, USA for the resolution of any dispute not resolved informally under Section 18.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

21. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent changes. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
